Year-end Tax Tips
  The first, and most important, step is to talk with your tax adviser. Tax laws are complicated and each case is unique. Only your own advisor can properly counsel you.

If you're a cash basis taxpayer, pay invoices due in January early-- prior to year end. Put off revenue where possible. Every cent earned up to Dec. 31, 2006 has taxes paid in April 2007; whereas income deferred to January 2007, will not owe taxes until April 2008. Of course, any deferral strategy will depend on your profit and losses for the year and your corporate legal structure. However, the Democratic Congress may work against you if President Bush doesn't hold the line. If you've had a bad year--you have no profits or are in a low tax bracket for 2006--reverse this and accelerate income and delay expenses.

Landlords: Beware of Boilerplate
  When an injury occurs on a portion of the premises or because of an activity exclusively under the control of the tenant, the landlord is not liable since he exercises no measure of control over the area or the activity. If, however, the tenant does not have exclusive control over the area, the question arises as to whether the landlord retained sufficient control to create a duty on his part to exercise due care in maintaining the area. In a case decided during 2006 by the Colorado Court of Appeals, the lease under which the parties operated contained some standard provisions that are fairly common:

  Nancy has been a part of the Steven M. Bush Law firm since April. She recently graduated from the Denver Career College with her paralegal certificate. Nancy also is a certified notary, a member of the Colorado Bar Association and a graduate of Sam Houston State University with a Bachelor of Science in Political Science. A newlywed, Nancy moved from Texas to Colorado in February and looks forward to trying skiing this winter.
 

Beware of Tax Law Reversions Set for 2010
  If you are considering accepting installment payments that stretch into the year 2011 and beyond for the sale of a capital asset, you should keep in mind that the tax rates on gains from the sale of capital assets revert to higher rates in 2011. If Congress fails to act between now and then, your installment payments will become significantly less valuable.
 

New Law Requires You to Verify Legal Work Status
  Remember that under legislation enacted during the special session this summer--starting Jan. 1, 2007--each employer is required to affirm, within 20 days after hiring a new employee, that the employer has examined the legal work status and the documents required by Federal law to prove that the new employee is authorized to work in the U.S. The employer is required to keep copies of the affirmation and the documents required by Federal law during the entire term of employment.
